Hiring Foreign Employees in Turkey 2026: An Employer's Guide to Rules, Costs and Penalties
Contents (21 sections)

A CNC machinist at a factory in Gebze, a pattern maker at a textile plant in Çorlu, a senior developer at a software company in Istanbul, a multilingual receptionist at a hotel in Bursa... Hiring foreign employees in Turkey is no longer something only large holding groups do; it is on the agenda of many SMEs across the Marmara region, as well as international and foreign-owned companies operating in the country. But hiring a foreign national follows different rules from hiring a Turkish citizen: work permit first, start date second. In this guide we bring together, on a single page, the 15 core rules employers need to know as of 2026, the quota calculation, the salary thresholds, a realistic cost table and the penalties for unauthorized employment.

This guide is written for HR and relocation managers, founders of international and foreign-owned companies in Turkey, and owners of factories, hotels, restaurants, construction firms, textile businesses and software companies. If you would like us to manage the application end to end on your behalf, take a look at our company work permit service.

What does hiring foreign employees in Turkey involve, and what are the conditions?

Hiring a foreign employee means employing a person who is not a Turkish citizen at a workplace in Turkey (officially Türkiye) under a valid work permit issued by the Ministry of Labour and Social Security (MoLSS) under the International Labour Force Law (No. 6735), and registering that person with the Social Security Institution (SGK). The employer files the application, the permit is tied to a specific employer and workplace, and the employment, financial and salary criteria must be met.

5:1At least 5 Turkish employees for each foreign employee
500,000 TLMinimum paid-in capital for a new company
30 daysReview period for a complete application
13,538.90 TL1-year permit fee + card fee

The 15 rules below are designed as a checklist both for employers hiring foreign staff for the first time and for companies that already employ foreign nationals and want to keep their inspection risk to a minimum.

1. Work permit first, start date second: the employer applies

As a rule, a foreign national needs a valid work permit to work in Turkey, whether the work is paid or unpaid, full-time or part-time. Arrangements such as a "trial period," "helping out for a few days" or "let them start until the permit comes through" have no legal basis; every day worked before the permit is approved counts as unauthorized employment.

The application is filed by the employer, not by the foreign national (if you are the candidate, your future employer files it for you): an authorized company representative logs in to the MoLSS e-İzin system through e-Devlet, Turkey's e-government portal, and uploads the workplace's and the foreign employee's documents electronically. We explain the application types and document details separately on our work permit in Turkey page.

Applying from within Turkey

If the foreign national is already in Turkey and holds a residence permit valid for at least 6 months, the application can be made from within the country. As a rule, a student residence permit does not qualify for this route. If the candidate's residence permit is shorter than 6 months, their residence permit situation must be clarified first.

Applying from abroad

If the foreign national is in their home country, they apply for a work visa at the Turkish consulate in the country where they are. After the consulate application, the employer must upload the required documents to the e-İzin system within 10 days. If this deadline is missed, the application may not be processed, so the consulate appointment and the employer's preparation need to be planned on the same timeline.

A common mistake

Putting a foreign national who arrived on a tourist visa or visa-free entry to work on the assumption that "we'll sort out the permit here." Without a residence permit valid for at least 6 months, the in-country application route is closed, and every working day carries the risk of unauthorized employment.

2. Your workplace must meet three core assessment criteria

The MoLSS assesses applications to employ foreign staff not only on the foreign national's qualifications but also on the structure of the workplace. In current practice, three criteria stand out:

  • Employment criterion: At workplaces subject to balance-sheet accounting, at least 5 Turkish citizens must be employed for each foreign employee.
  • Financial criterion: The workplace's economic adequacy, measured by paid-in capital, net sales or export volume.
  • Salary criterion: The gross salary paid to the foreign employee must not be lower than a set multiple of the gross minimum wage, depending on the position.

Alongside these three criteria, the MoLSS takes a holistic look at whether the position is a genuine need at the workplace, the foreign national's education and professional experience, the nature of the job and the consistency of the documents in the file. Meeting the criteria is the necessary foundation for approval, but on its own it does not secure approval.

3. The quota calculation: 5 Turkish employees for each foreign employee

The question employers ask most often is "How many foreign employees can my company hire?" The basic formula is simple: take the number of Turkish-citizen employees actively registered with SGK at the workplace where the foreign employee will work, divide it by 5 and drop the decimals. The result is the maximum number of foreign employees you can employ at the same time under the employment criterion.

Turkish employees registered with SGKCalculationForeign employees allowed (employment criterion)
44 ÷ 5 = 0.80 (criterion not met)
55 ÷ 5 = 11
1212 ÷ 5 = 2.42
2323 ÷ 5 = 4.64
5050 ÷ 5 = 1010

For example, a chemicals supplier in Dilovası with 23 Turkish employees can employ at most 4 foreign nationals under the employment criterion. For a fifth foreign employee, its Turkish headcount would need to rise to 25. The calculation is redone at every extension; if your Turkish headcount falls, the extensions of your existing foreign employees are also put at risk.

Workplaces with net sales of 50 million TL or more

Workplaces whose net sales for the last year were 50,000,000 TL or more are exempt from the employment criterion for up to 5 foreign employees. An automotive supplier in Bursa that has reached this turnover will not be held back by this requirement for up to 5 foreign employees, regardless of its Turkish headcount; requests beyond five should be checked separately.

For a quick preliminary calculation with your own figures, use our foreign employee quota calculator; it also takes into account the net sales exemption and the new relief introduced in 2026.

Free calculatorForeign Employee Quota in Turkey: 2026 CalculatorUse your Turkish headcount and financial data to see how many foreigners your company can employ and your remaining…

4. From 3 August 2026: criteria exemption for up to 3 foreign employees

The 2026 change that matters most to employers is a new relief for foreign nationals who have already been legally present in Turkey for a certain period. From 3 August 2026, for foreign nationals who have held a work permit, a residence permit or international protection status in Turkey for at least 1 year within the last 3 years, the employment criterion and the financial criterion are not applied for up to 3 foreign employees per workplace.

This relief has two important limits:

  • The number of foreign employees with work permits at the workplace cannot exceed the number of Turkish-citizen employees.
  • From the 4th foreign employee onward, the requirement to employ 5 Turkish citizens and the financial criterion apply again.

Example: a small production workshop in Hendek

Consider a workshop in Hendek, Sakarya, with 2 Turkish employees. The workshop wants to hire 3 foreign nationals, each of whom has spent at least 1 of the last 3 years in Turkey on a residence permit. Although the new rule does not apply the employment and financial criteria, the number of foreign employees cannot exceed the number of Turkish employees, so the workshop can currently apply for at most 2 foreign employees. Once it hires a third Turkish employee, the way opens for the third foreign employee as well.

A new advantage in recruitment

To use the exemption, the foreign national's previous permits in Turkey must be documented. When choosing candidates, asking "Has this person been legally present in Turkey for at least 1 year in the last 3 years?" can make a significant difference for small businesses.

5. The financial criterion and newly established companies

The financial criterion shows whether the workplace has the economic strength to employ foreign staff. The rules differ depending on whether the company is newly established or already operating:

Company statusFinancial requirement
Newly established companyPaid-in capital of at least 500,000 TL
Existing (operating) companyPaid-in capital of 500,000 TL or net sales of 8,000,000 TL in the last year or exports of 150,000 USD (meeting one of these is enough)

The most common problem here is the difference between "committed" capital and "paid-in" capital. Having 500,000 TL of capital written in the articles of association is not enough on its own; payment of the capital must be shown through trade registry records and financial documents.

Foreign founders and foreign shareholders

If you are a foreign national who has set up a company in Turkey and wants to employ yourself in it as a shareholder, additional conditions apply: the foreign shareholder's capital share must be at least 500,000 TL, their shareholding at least 20%, and the company's capital at least 500,000 TL. Foreign shareholders who invest 100,000 USD or more are exempt from these conditions. For new companies, it should also be checked before applying at which stage the employment criterion will be applied.

6. Salary criterion 2026: minimum gross salary by position

The gross salary you declare in an application to employ a foreign national cannot be lower than the position-based multiple of the gross minimum wage in force on the application date. With the 2026 gross minimum wage at 33,030.00 TL, the current minimum thresholds are as follows:

PositionMultiplier2026 minimum gross salary (monthly)
Senior executives, pilots5×165,150.00 TL
Engineers, architects4×132,120.00 TL
Other managers (unit managers, department managers, etc.)3×99,090.00 TL
Jobs requiring expertise or mastery of a trade2×66,060.00 TL
Domestic services and other jobs1× (cannot be below the minimum wage)33,030.00 TL

Amounts apply to 2026 and are updated when the legislation changes.

Consistency between the position, the diploma and the job description is critical. Applying for someone with a mechanical engineering degree under a "technician" title and a 2× salary creates a contradiction in the file; listing someone who will work as a skilled tradesperson as a "manager" will also cause problems at inspection. The right title, the right salary and the right documents must all line up.

To see the minimum threshold for your position and the total cost to the employer, use our foreign employee salary calculator.

7. Foreign nationals exempt from the criteria, and qualified staff

Some foreign nationals are exempt from part of the assessment criteria because of their personal circumstances. If your candidate falls into one of these groups, even a business whose quota is full or a small business can apply:

  • People whose mother, father or child is a Turkish citizen
  • People who have been married to a Turkish citizen for at least 3 years
  • Holders of a long-term residence permit
  • Holders of a humanitarian residence permit and victims of human trafficking
  • Holders of a stateless person identity card
  • People who have been in Turkey for at least 8 years on certain permits (from 3 August 2026)
  • Foreign nationals of Turkish descent (subject to conditions) and citizens of the Turkish Republic of Northern Cyprus (TRNC)

An exemption does not mean the file will not be examined; documents proving the exemption (civil registry records, marriage certificate, residence history, etc.) must be attached in full. And in no case can the salary be lower than the minimum wage.

The Turquoise Card for qualified staff

For highly qualified foreign nationals in software, R&D, engineering or academia, the Turquoise Card route can be considered instead of a standard fixed-term work permit. The Turquoise Card is a special status granted to foreign nationals who stand out for their level of education, professional experience, contribution to science and technology, or investment, and it offers rights close to an indefinite right to work. The first years operate as a transition period; the card also provides residence advantages for the cardholder's spouse and children.

Indefinite work permit

Foreign nationals who hold a long-term residence permit or who have held legal work permits for at least 8 years can apply for an indefinite work permit. The fee for an indefinite work permit in 2026 is 125,802.20 TL. This is why, for employers planning permanent positions, it is important to keep an employee's permit history unbroken.

Would you like a free initial assessment of your case?Tell us about your situation and we’ll send you the right permit type, the document checklist and the total cost the same day.

8. SGK registration and contributions: stay consistent with the salary you declared

The SGK employment start notification for a foreign employee whose work permit has been approved must be submitted before the employee starts work, just as for Turkish employees. Foreign employees are subject to the same contribution rates as Turkish employees: the employee's share is 14% SGK + 1% unemployment insurance; the employer's share is 21.75% SGK + 2% unemployment insurance.

The critical point is this: the salary you report to SGK must not be lower than the salary you declared in the work permit application. SGK records are reviewed at extension; if 132,120 TL was declared for an engineer but contributions were reported to SGK on the minimum wage, the extension may be refused and administrative sanctions become a risk. If you are the foreign employee, it is worth making sure that your own SGK record reflects the salary in your permit application for the same reason.

A note on incentives

The calculations in this guide assume no incentives (employer contribution of 23.75%). Check with your accountant whether social security contribution incentives can be applied to foreign employees.

9. Prepare a written employment contract and a consistent document file

One of the most common problems in work permit applications is inconsistency between documents. The title, salary and working hours in the employment contract must match the application form, diploma, passport details and SGK data exactly. Even a small difference in the spelling of a name can cause delays.

What the employment contract should include

  • The full legal names of the parties, the workplace address and the SGK workplace registration details
  • Position, title and job description
  • Gross salary (an amount that meets the salary criterion)
  • Working hours, start date and a clause making the contract conditional on the work permit being obtained
  • A Turkish text (together with a translation in a language the foreign employee understands, if needed)

Typical document list

  • The foreign national's passport and, for in-country applications, a valid residence permit
  • Biometric photo
  • Diploma and, if required, equivalence or vocational qualification certificates (translated and certified)
  • Employment contract signed by both parties
  • The company's current Trade Registry Gazette and documents showing its shareholding and capital structure
  • Last year's balance sheet and income statement, or export documents (for the financial criterion)
  • SGK employee list (for the employment criterion)
  • Documents proving the exemption, if there is one

In regulated professions such as healthcare or education, additional approvals from the relevant authorities may also be required.

10. Pay the fee and card fee within 30 days of approval

When the application is approved, the employer receives an approval notification. The work permit fee and the card fee must be paid within 30 days of this notification. If they are not paid, no further action is taken, the application is rejected and the process starts over.

Item2026 amount
Fixed-term work permit fee (up to 1 year)12,574.90 TL
Fixed-term work permit fee (2 years)25,149.80 TL
Fixed-term work permit fee (3 years)37,724.70 TL
Work permit card (security document) fee964.00 TL
Total for a 1-year fixed-term permit13,538.90 TL
Indefinite and independent work permit fee125,802.20 TL

Amounts apply to 2026 and are updated when the legislation changes. For different durations and numbers of employees, our work permit fee calculator shows the total instantly.

Permit durations

A fixed-term work permit is granted for a maximum of 1 year on the first application, up to 2 years on the first extension and up to 3 years on subsequent extensions. A valid work permit also counts as a residence permit, so your foreign employee does not need a separate residence permit. Their spouse and children, however, need separate family residence permits.

11. Extend before the permit expires (start 60 days ahead)

An extension application can be filed starting 60 days before the permit expires and must be completed before the permit runs out. An application filed after expiry may not be treated as an extension, which means both a break in employment and a gap in the foreign employee's legal stay.

  • Mark the permit expiry dates of all foreign staff in your HR calendar with an alert at least 90 days in advance.
  • Before the extension, check that SGK reports match the declared salary.
  • Redo the quota calculation; if your Turkish headcount has dropped, take action.
  • Check passport validity; a passport close to expiry can limit the duration of the permit granted.

When a foreign employee leaves, the employment contract is terminated or the work actually ends, the employer is obliged to notify both SGK and the MoLSS within the legal deadline. A work permit does not close automatically when the employment relationship ends; a permit whose termination has not been reported creates a risk of an administrative fine for the employer.

When the work permit is cancelled, the foreign national's basis for staying in Turkey also disappears. If there is a new employer, that employer needs to apply; if not, alternatives such as a short-term residence permit need to be considered quickly, otherwise the foreign national may end up in breach of residence rules. For employees whose residence application has been rejected, our guide on what to do if your residence permit is rejected will point the way.

13. A work permit is valid only at the workplace it was issued for

A work permit does not give a person a general right to work; it is issued for a specific employer and workplace. In practice this rule means:

  • You cannot permanently employ a foreign employee whose permit was issued for your Gebze factory at your second facility in Çerkezköy; a different workplace requires a separate assessment.
  • "Lending" staff between group companies (including sister entities of an international group in Turkey) or sending them to another workplace through a subcontractor may fall outside the scope of the permit.
  • A foreign employee doing a "side job" somewhere else on weekends also needs a separate permit.

Whenever the company's address, trade name or structure changes (merger, demerger, relocation), you also need to review the status of existing permits.

14. Watch the limits for interns, students and part-time work

Employing foreign students without a permit on the assumption that "they're university students, they already have a residence permit" is a common mistake, especially in restaurants, cafés and hotels. A student residence permit does not give the right to work. Foreign students also need a work permit to work, and this permit is subject to different limits depending on the level of study; for example, associate and bachelor's degree students may be able to work only under certain conditions and on a part-time basis.

Some situations, such as a compulsory internship, may be treated as falling under a work permit exemption; however, the exemption does not arise automatically and requires a separate application and fee. Actual work carried out under the label of "volunteer," "intern" or "trial" may be treated as unauthorized employment at inspection.

15. Employing foreign workers illegally comes at a heavy price: penalties and inspections

Sanctions for the employer and the foreign national

The consequences of employing foreign staff without a work permit far outweigh any cost advantage it seems to offer in the short term:

  • For the employer: A separate, substantial administrative fine for each foreign national employed without a permit. Fine amounts increase every year by the revaluation rate.
  • For the foreign national: A separate administrative fine for the foreign national working without a permit, plus the risk of deportation (removal) and an entry ban to Turkey.
  • Return costs: The employer may be required to cover the return travel costs of a foreign national who is deported.
  • SGK: Additional SGK administrative fines and retroactive contributions for uninsured employment.
  • Commercial risk: Serious reputational damage in customer audits across textile and automotive supply chains.

Because fines are applied per foreign national, finding 5 foreign nationals working without permits in one inspection means five separate fines.

Who carries out inspections, and how?

Foreign employment can be inspected by MoLSS labor inspectors, SGK inspectors, the Presidency of Migration Management (PMM) and law enforcement units. An inspection may start with a tip-off, a mismatch in SGK data, a routine sector inspection or an identity check; organized industrial zones, construction sites, hotels and restaurants are among the most frequently inspected places.

During an inspection, the work permit documents, SGK records and employment contracts of the foreign nationals at the workplace are requested. To be able to present these documents on the spot, we recommend keeping an up-to-date file for each foreign employee (copy of the permit card, SGK employment start notification, contract, fee receipt). If you face a fine or a deportation decision, we stand by you in objection and court proceedings through our partner attorneys, as part of our immigration legal support.

Cost of hiring a foreign employee in 2026: a 12-month comparison table

The table below shows the total 12-month statutory cost for three different profiles employed at the minimum of the salary criterion. The calculations use the employer burden without incentives (21.75% SGK + 2% unemployment = 23.75%, i.e. gross salary × 1.2375) plus the 1-year fixed-term work permit fee and card fee. In the domestic services column, the employer is the family employing the caregiver.

ItemForeign engineer (4×)Foreign skilled tradesperson (2×)Domestic services / caregiver (minimum wage)
Monthly gross salary132,120.00 TL66,060.00 TL33,030.00 TL

Total 12-month statutory cost1,975,520.90 TL994,529.90 TL504,034.46 TL

Amounts apply to 2026 and are updated when the legislation changes. The calculations are based on the minimum of the salary criterion; as the salary you pay rises, the SGK cost rises proportionally. Items such as visa procedures, flights, translation, accommodation and consultancy fees are not included in the table. For a caregiver on the minimum wage, the net take-home pay is 28,075.50 TL thanks to the income tax and stamp duty exemption.

Practical takeaways from the table

  • The fee and card fee make up roughly 0.7% of the total 12-month cost for the engineer, about 1.4% for the skilled tradesperson and about 2.7% for domestic services. In other words, the main cost item is not the permit fee but the salary and SGK contributions.
  • The fees and contributions "saved" by employing someone illegally are negligible next to the per-person administrative fines and the risk of retroactive contributions.
  • The domestic services column also gives families, including expat households, a realistic idea of what a foreign caregiver costs. We explain this process in detail in our foreign nanny guide for working mothers and dual-career families.
Leave the process to the experts and save timeMissing documents and incorrect applications are the most common reasons for rejection. Let’s get your file right from the start.

Hiring foreign employees by sector: practical notes

Factories and organized industrial zones

At chemical, metal and machinery manufacturers in Gebze and Dilovası, at textile and packaging plants in Çerkezköy and Çorlu, and in Bursa's organized industrial zones dominated by automotive suppliers and textiles, the most sought-after foreign profiles are CNC operators, welders, maintenance technicians and project engineers. For these positions, the salary criterion is 2× for skilled tradespeople and 4× for engineers.

Hotels, tourism and restaurants

Multilingual receptionists, guest relations staff and world-cuisine chefs are positions employers frequently apply for. For seasonal work, it is important that the permit duration matches the season and that departures are reported at the end of the season; in restaurants, the distinction between a "master chef" and "support staff" directly affects the salary criterion.

Construction

Because of the subcontractor structure, the question "Which employer does the permit belong to?" is critical. A foreign employee must work on the payroll and at the workplace of the company in whose name the permit was obtained; check the scope of the permit whenever the construction site changes.

Textiles and garments

For positions such as sample maker, pattern cutter and quality control specialist, certificates of mastery and experience are decisive. The temptation to employ workers without permits "for just a few weeks" during order peaks carries a serious risk of fines.

Software and technology companies

For positions such as senior developer and product manager, the engineer (4×) or manager (3× to 5×) categories come into play. Foreign nationals who live in Turkey and work remotely for a Turkish company also need a work permit; for highly qualified candidates, the Turquoise Card should be considered.

Frequently asked questions

As a rule, at least 5 Turkish citizens must be employed for each foreign employee; divide your number of SGK-registered Turkish employees by 5 to find the upper limit. Workplaces with net sales of 50,000,000 TL or more in the last year are exempt from this criterion for up to 5 foreign employees. From 3 August 2026, there is also additional relief for up to 3 people per workplace for certain foreign nationals.

Without incentives, the employer's cost is 1.2375 times the gross salary. At the minimum of the salary criterion, the monthly cost to the employer is 163,498.50 TL for a foreign engineer, 81,749.25 TL for a skilled tradesperson and 40,874.63 TL for a caregiver in domestic services. On top of this come 13,538.90 TL in fees and card fee for a 1-year permit.

No. Work cannot begin until the permit has been approved, the fee paid and the SGK registration made; otherwise both the employer and the foreign national face the risk of an administrative fine.

Yes, but a newly established company must have paid-in capital of at least 500,000 TL. At which stage the employment criterion will apply, and the additional conditions for foreign shareholders, should be checked separately. We recommend a company work permit pre-assessment before you apply.

For engineers and architects, the salary criterion is 4 times the gross minimum wage; in 2026 this means at least 132,120.00 TL gross per month. The minimum thresholds are 165,150.00 TL for senior executives, 99,090.00 TL for other managers and 66,060.00 TL for skilled tradespeople and specialists.

The employer receives a separate, substantial administrative fine for each foreign national employed without a permit, and the amounts increase every year by the revaluation rate. The foreign national may also face a fine, deportation and an entry ban.

The employer must notify SGK and the MoLSS that the employment relationship has ended within the legal deadline; otherwise there is a risk of an administrative fine. To stay in Turkey, the foreign national needs a new work permit or a residence permit.

No. A work permit is tied to a specific employer and workplace; working at another workplace, including a group company, requires a new application in the name of that employer.

A student residence permit does not give the right to work. Foreign students can work only within the limits set for their level of study and after a work permit has been obtained.

Complete applications are decided by the MoLSS within 30 days. If missing documents are requested, it takes longer; for applications from abroad, the consulate and visa stage must also be added to the timeline.
